This website is owned and operated by Hasha Ibiza ESPJ. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors information and third-party booking options for but not solely for e-bike hire, yoga, guided meditation, boat hire and lunch and dinner bookings. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

In order to use our website and/or receive our services, you must be at least 16 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

​If purchasing an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

 For any undamaged product, simply return it with its included accessories and packaging along with the original receipt (or gift receipt) within 14 days of the date you receive the product, and we will exchange it or offer a refund based upon the original payment method. In addition, please note the following: (i) Products can be returned only in the country in which they were originally purchased; and (ii) the following products are not eligible for return: Food goods and drinks bottles for hygiene reasons. 

 We may, without prior notice, change the Services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

When we receive a valid warranty claim for a product purchased from us, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund upon the prompt return of the product to us. We will pay for the shipment of repaired or replaced products to the customer and the customer will be responsible for the return shipment of the product to us.

 The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Hasha Ibiza. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

 You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed on the website.

You agree to indemnify and hold Hasha Ibiza harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

 To the maximum extent permitted by applicable law, in no event shall Hasha Ibiza, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Hasha Ibiza assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

 We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Unsafe Use. If at any time the “company”- “Hasha Ibiza” determines that Renter has engaged in an unsafe or hazardous use, The “company” representative may notify the Renter that it is immediately terminating the rental. Upon termination, Renter must return immediately. If the rental is terminated for unsafe or hazardous use, the Renter will not be refunded his/her security deposit. “The company” shall determine, in its sole discretion, whether any behaviour or activity is “unsafe or hazardous.”

 You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time. 

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of Spain.



Cancellation policy

 

All booking are subject to amendments by Hasha Ibiza, from time to time we may have to change your booking, we will always contact you to discuss this.

As the Company will have incurred the majority of its costs before the activity starts, we need to impose cancellation charges to cover these costs. Tailor-made tours/activities/service may be subject to alternative cancellation terms, which will be communicated to applicable clients at the time of booking. 

​Once the tour/activity/service has started, no refund for any unused portion or part of the tour or services to be provided will be given. 

All cancellations or booking changes must be in writing and be made by the person who submitted the booking form. 

 For bookings made directly with Hasha Ibiza ESPJ (via email, telephone, website) cancellations can be made up to 30 days before your booking date with a full refund, not including the deposit. The deposit amount is 50% of the booking total. 

​Payment is of course a fundamental part of Hasha Ibiza's income and contributes to the overall cost of equipment, running costs, staffing, administration, etc.

​If cancellations are made within 30 days of your booking date, the payment and deposits are non-refundable. 

​If more than 2 weeks notice is given prior to the booking date, there is the option to reschedule the booking for another date but this is only within the availability of Hasha Ibiza’s schedule. Anything after this window of time we will unfortunately not be able to reschedule. We will however endeavour to accommodate changes for exceptional circumstances. 

​For bookings made via a travel/booking agent please contact the agent directly for their cancellation policies and to check the terms of your booking. 

For bookings made or payments are taken via Hasha Ibiza on behalf of third-party activities or businesses the terms and conditions/cancellation policies of said business will apply, you must check this prior to booking

​We recommend all clients take out travel insurance to cover any cancellations outside of the Hasha Ibiza ESPJ cancellation window. 

​In the unlikely event that Hasha Ibiza has to cancel your booking due to a double booking through online agents, you will be given a full refund of the total payment including the deposit. Hasha Ibiza espj maybe need to amend and or cancel your bookings from time to time this can be done at any time and for any reason, we will inform you of any changes and reschedule your booking or provide a full refund.

Cancellations due to bad weather- as the Company will have incurred costs before the activity starts, we will not be able to refund the for bad weather the customer books in the knowledge that if the weather is too dangerous for the activity Hasha Ibiza has the right to cancel the activity without refunding the payment. Hasha Ibiza has the final say on weather conditions. We can however arrange a second option in case of bad weather if requested by the client at the time of booking. This wet weather option must be payed in full ahead of time and is none refundable.

Privacy policy

 

We receive, collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; e-mail address; computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile.

 

When you conduct a transaction on our website, as part of the process, we collect the personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated above only.

 

We collect such Non-personal and Personal Information for the following purposes:

  1. To provide and operate the Services;

  2. To provide our Users with ongoing customer assistance and technical support;

  3. To be able to contact our Visitors and Users with general or personalized service-related notices and promotional messages;

  4. To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services; 

  5. To comply with any applicable laws and regulations.

 

Our company is hosted on the squarespace.com platform. squarespace.com provides us with an online platform that allows us to sell our products and services to you. Your data may be stored through squarespace.com’s data storage, databases and the general squarespace.com applications. They store your data on secure servers behind a firewall. 

 

All direct payment gateways offered by squarespace.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

 

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. For these purposes, we may contact you via email, telephone, text messages, and postal mail.

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. Rental agreements & Deposits

 

Biker's Responsibility

It shall be the responsibility of the person renting the e-bike to comply with the following:

  1. It shall be the responsibility of the Biker to not ride on any sand or water or leave unsheltered in heavy rainfall.

  2. Bikers shall comply with the proper traffic laws at all times.

  3. Biker is not allowed to replace or substitute any parts or portions of the bicycle.

  4. Biker is not required nor recommended to clean the bicycle prior to returning the said bicycle.

  5. Biker is required to maintain proper responsibility in the use of the bicycle. Biker shall assume for any and all liabilities, damage, loss to property, or injury related to the rent and use of the bicycle.

  6. Biker is not allowed to sublease the bicycle rented with us.

  7. Biker confirms they are a confident and safe cyclist

  8. Bikers will not ride under the influence of drugs or alcohol

  9. If the biker is suspected to be intoxicated then the hire or tour will be terminated with no refund

  10. If the Biker fails to adhere to safety instructions or rules as specified by a guide or other staff member at any time then the hire or tour will be terminated with no refund given

  11. The bikes must never be taken off the island, the rental is only for use on Ibiza

  • Assumption of Risk

    I hereby declare that I understand and accept the risk that renting a bicycle or riding a bike has a high risk of exposure to many hazards and accidents which may lead to damage to property, physical injury, or death. I further declare that I am in good physical health and capable of participating in the physical activity of riding a bicycle.

    I hereby assume all risk of physical injury or loss of life that may cause me or loss or physical damage to the properties that may be involved arising from an accident out of the bicycle I rent. I fully understand the inherent risk involved and I accept full responsibility for any and all damage or injury from which it may result.

    Release Waiver

    I hereby release, quitclaim, and forever discharge the Company, its agents, officers, representatives, and employees from any and all liability or claims of illness, injury, loss or damage to property, or death resulting from my activity in riding a bicycle leased or rented from them.

    I have fully and carefully read this agreement and have been afforded the opportunity to ask for clarifications with regard to any information that is unclear to me and which was answered to my satisfaction. I executing this agreement freely and voluntarily with full knowledge and understanding of the consequences this may incur. 

Deposits

Each bike will require a 100€ holding deposit via bank card and must be made before the rental or activity/tour.

The deposit will be a group deposit, In the case of damage, the damage amount will be deducted from the entire group where and if necessary.

Card deposit may take up to 5 days to be returned depending on the bank.

Full parts costs can be requested by the client.

 

Age & size requirements

All under 18’s must be accompanied by an adult and have permission from their parent or guardian. The minimum age is 14 years old.

The minimum height requirement for the Lil Buddy e-bike is 155cm as specified by the manufacture.

 

 

 

 

Corporate & large group bookings

 

For all Corporate and large group bookings, full terms and conditions stated above apply. In addition to said terms and conditions, the following apply 

Payment & booking confirmation - 

All bookings are only confirmed and finalised once payment has been made unless otherwise stated, availability for all activities on the island is limited for large groups and we advise securing the activities promptly to avoid disappointment. All third-party bookings are subject to availability and availability can't be guaranteed until the booking has been formally confirmed and payment has been received. 

Cancellations- 

Please see our full cancellation policy above. Including our wet/bad weather policy.

Option 1 = Primary planned activities

Plan B = Secondary, wet/bad weather plan

 If you have opted for a bad weather activity plan this must be formally booked prior to your booking. Your plan B option must be paid in full, no refunds are offered on plan B activities, and the booking is made with the understanding that this activity will only take place if the weather is bad and the Option 1 activity is formally cancelled by the activity operator. The group must remain as one and may not split between activities. 

For bookings made with third-party operators/activity providers their full terms and conditions apply. You are responsible for checking said terms. You will be making the booking directly with each provider. 

Our service & hosting fees- 

Bookings are subject to a service fee, this will vary from 5-20% of the total booking depending on the activities and specific group requirements. In addition to the service fee, we may apply a hosting fee where necessary. All fees will be highlighted once all activities have been requested and will be added to the quotation. 

Ibiza & formentera Preservation- 

At Hasha Ibiza, we are passionate about the island we call home and we would like you to help us preserve it. We have partnered with the not-for-profit Foundation to help them in their work to protect and restore the natural resources of Ibiza and Formentera. With all group bookings, 1% will be added to your booking going directly to Ibiza Preservation. Together we hope we can help preserve this beautiful island.
